EXCHANGE OF NOTES BETWEEN THE REPUBLIC OF THE PHILIPPINES AND THE KINGDOM OF BELGIUM RELATING TO THE GRANT OF FINANCIAL ASSISTANCE BY THE KINGDOM OF BELGIUM TO THE REPUBLIC OF THE PHILIPPINES. MANILA, NOVEMBER 13, 1972.

Excellency,

I have the honor to refer to Your Excellency's Note of today's date, the text of which is quoted in full as follows:

"With a view to implementing the Provisions of Article 4 of the Agreement reached today between the Government of the Kingdom of Belgium and the Government of the Republic of the Philippines. I have the pleasure in suggesting that the following technical procedures be adopted:

1. The sums in Belgian franc made available to the Philippines under Article 1 (hereinafter referred to as "sums in Belgian francs") shall be used solely for payments in favor of persons and firms whose trading activity is located in Belgium, for capital goods and equipment of Belgian origin or for services in this connection, effected in compliance with the specific performance of contracts for which import licenses, where required, have been issued, after the date of signature of the abovementioned Agreement.

2. The Government of the Philippines shall forward through diplomatic channels to the Ministry of Foreign Affairs and Foreign Trade of Belgium photocopies of the contracts against which payment is to be effected by means of the sums in Belgian francs.

The afore-mentioned Ministry may request the Government of the Philippines to supply such additional information as may be necessary to ascertain whether the payments due for the performance of the relevant contracts are in conformity with the objective of the Agreement.

These contracts shall include the following information:

a) date of issue of the import license, where this document is required;

b) the nature of the goods supplied, and also the relevant item numbers of the customs tariffs of the Philippines;

c) the desirability of supplying a Belgian certificate of origin.

3. Payment orders against the sums in Belgian francs in respect of payments provided for by the above-mentioned contracts shall be forwarded to the National Bank of Belgium by the Government of the Philippines along with a photocopy of the invoices made out by the Belgian suppliers. The reference numbers of the relevant contracts shall be quoted in the said invoices.

I should be grateful if you would kindly confirm that your Authorities agree with these "provisions."

I have the honor of confirming herewith that my Government agrees with these provisions.
