[ REPUBLIC ACT NO. 11279, April 12, 2019 ]
AN ACT TRANSFERRING THE PHILIPPINE NATIONAL POLICE ACADEMY (PNPA) AND THE NATIONAL POLICE TRAINING INSTITUTE (NPTI) FROM THE PHILIPPINE PUBLIC SAFETY COLLEGE (PPSC) TO THE PHILIPPINE NATIONAL POLICE (PNP), AMENDING FOR THE PURPOSE SECTIONS 24, 35, 66, 67 AND 68 OF REPUBLIC ACT NO. 6975, OTHERWISE KNOWN AS THE "DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT ACT OF 1990", AS AMENDED, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. Section 24 of Republic Act No. 6975, as amended, is hereby amended to read as follows:
"SEC. 24. Powers and Functions. - The PNP shall have the following powers and functions:
"x x x.
"In addition, the PNP shall absorb the office of the National Action Committee on Anti-Hijacking (NACAH) of the Department of National Defense, all the functions of the present Philippine Air Force Security Command (PAFSECOM), as well as the police functions of the Coast Guard. In order to perform its powers and functions efficiently and effectively, the PNP shall be provided with adequate land, sea, and air capabilities and all necessary material means or resources.
"To better achieve the goals of a highly efficient and competent police force, the Philippine National Police (PNP) shall have administrative and operational supervision and control over the Philippine National Police Academy (PNPA) established pursuant to Section 13 of Presidential Decree No. 1184, and the National Police Training Institute (NPTI), formerly known as the Philippine National Training Center (PNTC)."
SEC. 2. A new Section 35-A is hereby inserted in the same act to read as follows:
"SEC. 35-A. National Police Training Institute (NPTI). - The NPTI shall be responsible for the mandatory and leadership trainings of all police non-commissioned officers (PNCOs). The supervision and control over the NPTI shall be established in the revised table of organization and equipment and staffing pattern under Section 68-B.
"The NPTI shall be headed by a Director with the rank of Police Major General."
SEC. 3. Section 69 of the same Act is hereby amended to read as follows:
"SEC. 66. Creation of the Philippine Public Safety College. - There is hereby created the Philippine Public Safety College (PPSC), which shall be the premier educational institution for the training, human resource development and continuing education of all personnel of the Bureau of Fire Protection and Bureau of Jail Management and Penology and the provided of select mandatory career courses for police commissioned officers and specialized courses for personnel of the PNP.
"The College shall be under the direct supervision of a Board of Trustees composed f the Secretary and the thee (3) bureau heads."
SEC. 4. Section 67 of the same Act is hereby amended to read as follows:
"SEC. 67. Composition, Powers and Functions. - The College shall consist of the National Fire Training Institute, the National Police College, the National Forensic Science Training Institute, the National Jail Management and Penology Training Institute, and other special training centers as may be created by the Department, whose functions shall be as follows:
"(a) Formulate and implement training programs for all personnel of the Fire and Jail Bureaus and other training centers under the Department;
"(b) Formulate and implement select mandatory career courses for police commissioned officers;
"(c) Formulate and implement specialized courses for personnel of the PNP;
"(d) Establish and maintain adequate physical training facilities;
"(e) Develop and implement research and development to support educational training programs;
"(f) Conduct an assessment of the training needs of all its clientele; and
"(g) Perform such other related functions as may be prescribed by the Secretary."
SEC. 5. A new Section 67-A is hereby inserted in the same Act, to read as follows:
"SEC. 67-A. Philippine National Police Academy (PNPA). - The PNPA is the premier institution for police education, and the primary source for commissionship of police lieutenants. The PNPA shall be under the direct administrative and operational supervision and control of the Chief of the PNP.
"The PNPA shall be headed by a PNPA Director with the rank of Police Major General, who shall be assisted by a Deputy Director with the rank of Police Brigadier General. The PNPA shall have a Dean of Academics and a Commandant, both with the rank of Police Brigadier General."
SEC. 6. A new Section 68-A is hereby inserted to read as follows:
"SEC. 68-A. Transfer of Personnel and Properties. - The personnel and all the properties, facilities, records, equipment, funds, choses in action, appropriations, rights, functions, liabilities, and other assets of the PNPA and NPTI are hereby transferred to the PNP."
SEC. 7. A new Section 68-B is hereby inserted to read as follows:
"SEC. 68-B. Transition. - (a) Within one hundred twenty (120) days from the effectivity of this Act, the Chief of the PNP shall submit the revised table of organization and equipment and staffing pattern of the PNPA and the NPTI to the National Police Commission (NAPOLCOM) and the Department of Budget and Management (DBM) for approval. The revised table of organization and equipment and staffing pattern may include the reorganization and renaming of existing PNP training offices and units, and the realignment of functions as may be necessary;
"(b) The personnel of the PNPA and the NPTI shall be transferred from the PPSC to the PNP and continue to perform their duties and responsibilities and receive their corresponding salaries and benefits;
"(c) The PNP, PPSC, PNPA aand NPTI shall jointly conduct an inventory of all the properties, facilities, records, equipment, funds, choses in action, appropriations, rights, functions, liabilities and other assets of the PNPA and NPTI prior to their complete transfer to the PNP;
"(d) For a period of five (5) years from the effectivity of this Act, the PNPA shall continue to accommodate cadets for the Bureau of Jail Management and Penology (BJMP) and the Bureau of Fire Protection (BFP): Provided, That this period may be extended by the PNP upon the request of the BJMP and BFP in case the PPSC is still not able to provide the education and training required by the two (2) bureaus. Pursuant thereto, the Department of the Interior and Local Government (DILG), in consultation with the PPSC, is hereby authorized to create a separate academy for the BJMP and BFP. Thereafter, the PNPA shall produce graduates who will exclusively join the PNP: Provided, further, That the budget required for the per capita expenses for cadetship training during the transition period shall be included in the respective appropriations of the BJMP and BFP; and
"(e) The Secretary of the DILG and ex officio Chairman of the NAPOLCOM shall formulate and implement a five (5) year transition plan to ensure the smooth transfer of the PNPA and NPTI to the PNP."
SEC. 8. Within ninety (90) days from the effectivity of this Act, the National Police Commission, in coordination with the Philippine National Police, Philippine Public Safety College and Department of the Interior and Local Government shall promulgate the necessary rules and regulations to implement the provisions of this Act.
SEC. 9. The amount necessary for the initial implementation of this Act shall be charged against the current year's appropriations of the Philippine National Police Academy and the National Police Training Institute under the Philippine Public Safety College. Thereafter, such amount as may be necessary for its continued implementation shall be included in the annual General Appropriations Act.
SEC. 10. In case any provision of this Act or any portion hereof is declared unconstitutional, the remaining provision shall not be affected thereby.
SEC. 11. All laws, decrees, executive orders, rules and regulations, and other issuances or parts thereof which are inconsistent with this Act are hereby repealed, amended or modified accordingly.
SEC. 12. This Act shall take effect fifteen (15) days after its publication the the Official Gazette or in a newspaper of general circulation.
