AN ACT FURTHER TO AMEND SECTION SIXTEEN HUNDRED AND SEVENTY-THREE OF THE ADMINISTRATIVE CODE OF NINETEEN HUNDRED AND SEVENTEEN.
Be it enacted by the Senate and House of Representatives of the Philippines in Legislature assembled and by the authority of the same:SECTION 1. Section sixteen hundred and seventy-three of the Administrative Code of nineteen hundred and seventeen, as amended by Act Numbered Thirty-five hundred and eighty, is hereby further amended to read as follows:
"SEC. 1673. Office of provincial fiscal.—Except as otherwise provided there shall be a provincial fiscal for each province. To be eligible for appointment to this position a person shall be a citizen of the United States or of the Philippine Islands who has been duly admitted to practise in the courts of said Islands, and has been in actual practice for at least four years prior to his appointment, or has held during a like period, within the Philippine Islands or within the United States, the office of clerk of court, law clerk in a Bureau of the Insular Government, or an office requiring the services of a lawyer. He must be able to speak and write the Spanish language or the English language and, being conversant with one, he shall have at least a fair knowledge of the other. No person shall hold the office of city fiscal, or assistant city fiscal of Manila, provincial fiscal, or deputy fiscal after he attains the age of sixty years; and after the thirty-first day of December, nineteen hundred and thirty, any city fiscal or assistant city fiscal of Manila, provincial fiscal, or deputy fiscal over sixty years of age shall vacate his office."The salary of the provincial fiscal and all other expenses incident to the maintenance of his office shall be paid by the province or provinces to which the service rendered pertains."Clerks, interpreters, and other subordinates in the office of the provincial fiscal shall be appointed and their salaries fixed in the same manner as in the case of employees in other provincial offices."
SEC. 2. This Act shall take effect upon its approval.Approved, November 26, 1930.
