FULL TITLE : AN ACT AMENDING THE SUBDIVISION AND CONDOMINIUM BUYERS' PROTECTIVE DECREE |
SHORT TITLE : "The Subdivision and Condominium Buyers' Protective Decree Amendments of 2005." |
ABSTRACT : "The Subdivision and Condominium Buyers' Protective Decree Amendments of 2005". The bill proposes the following amendments, among others: a) the cancellation of the registration with the Register of Deeds of a contract to sell that has been rescinded will not longer require a court order but simply an affidavit, and b) the deed of sale or contract to sell a lot or unit, subject of a mortgage, will be required to include a partial release clause or a provision guaranteeing the release of the title upon full payment. |
