ABSTRACT : Death penalty is imposed if the crime of rape is committed when the victim is below 18 years old and the offender is a parent, descendant, step-parent, guardian, relative by consanguinity or affinity within the 3rd civil degree or the common-law spouse of the parent of the victim. In most cases, the tendency of the victim is not to report the incident or file charges against her parent who raped her because the penalty is death. This bill seeks to lower the penalty on incestuous rape from death to reclusion perpetua to encourage victims to report the incident, file appropriate charges and testify in court. |
