FULL TITLE : AN ACT PROVIDING FOR ABSOLUTE SEPARATION IN THE PHILIPPINES, AMENDING FOR THE PURPOSE EXECUTIVE ORDER NUMBERED TWO HUNDRED NINE, OTHERWISE KNOWN AS `THE FAMILY CODE OF THE PHILIPPINES', AS AMENDED |
ABSTRACT : As provided in this bill, the decree of LEGAL SEPARATION shall be the following effects: (1) The spouses shall be entitled to live separately from each other, [but the marriage bonds shall not be served]; AN TO REMARRY; (2) x x x (3) The custody ofthe minor children shall be awarded to the innocent spouse, subject to the provisions of Article 213 of this Code [;] PROVIDED, THAT THE CHILDREN SHALL CONTINUE TO ENJOY FILIAL RELATIONSHIP WITH BOTH SEPARATED PARENTS EXCEPT IN INSTANCES WHERE THE DECREE OF ABSOLUTE LEGAL SEPARATION WAS GRANTED ON THE GROUNDS ENUMERATED IN (1);(3) AND (3) OF ARTICLES 55 OF THIS CODE IN WHICH CASE THE GUILTY SPOUSE MAY NOT EXERCISE PARENTAL AUTHORITY. > x x x |
